Burlington  English  México SAPI de CV,  is  a  company  with  offices in Mexico located at Avenida Insurgentes Sur # 949 piso 2, Col Nápoles, Alcaldía Benito Juárez, C.P. 03810 Ciudad de México.  (hereinafter  referred  to  as  “Burlington  English  México SAPI de CV”).

Burlington  English  México SAPI de CV provides  all  Burlington  products  and  services  through  the  Websites  (jointly  the  “Products”),  namely: 

(i)  the  administration  and  conduct  of  tests  and  the  creation  and  supervision  of  a  VTest  Test  centers  network  in  the  LATAM  region  and  provision  of  related  services  (“Services”),  which  enable  (i)  businesses  –  legal  entities  (“Customers”)  to  ask  for  the  performance  of  tests  (“Tests”)  and  (ii)  individuals  (“Candidates”)  to  take  part  in  such  Tests  and  the  respective  website.  For  further  information  on  VTest  platform,  please  refer  to  https://www.vtest.com/privacy-policy/;

In  the  context  of  the  Websites  and  the  Services,  Burlington  English  México SAPI de CV  may  collect  and/or  process  information  about  Visitors,  Customers  and  Candidates  as  described  below.

We  collect  your  personal  data  when  you  use  our  Websites  and/or  Services  as  a  Visitor,  Customer  and/or  Candidate.  We  do  not  sell  your  personal  data  to  others,  and  we  only  share  them  with  third  parties  who  facilitate  the  provision  of  our  Services  to  you.

Burlington  English  México SAPI de CV can transfer your information to foreign or national third parties when: (i) the transfer is required by law or in international treaties in which México takes part; (ii) it is necessary for the services management; (iii) it is made by controlling entities, subsidiaries or affiliated under the common control of Burlington  English  México SAPI de CV, to an entity that is part of the same group of the responsible of the information, operating under the same processes and internal politics; (iv)  it is necessary in virtue of a contract celebrated or about to be celebrated between Burlington  English  México SAPI de CV and third parties, in interests of you; (v) it is necessary or legally required for protection of a public interest or for the administration of justice in legally  binding process under the Mexican law; (vi) it is precise for the appreciation, exercise or defense of rights in a legally binding process under the Mexican law; (vii) it is required  for the maintenance or fulfillment of a legal relationship between Burlington  English  México SAPI de CV

  1. ARCO Rights

Yourself or your legal representative can exercise, when it proceeds, the Access, Rectification, Cancelation or Opposition that the Federal Law of Protection of Personal Data Held by Private Parties provides by means of a request in the terms provided by the Law in its 29th article, directed to the Legal Department, which needs to be accompanied by the documents that evidence the identity of the holder (id with photograph) or the legal representation in terms of the common legislation, that must be send to the following email address: privacy@BurlingtonEnglish.com where in a term no longer than 20 working days following the reception, we will answer your requests for the exercise of the ARCO rights.

It is worth noting that the exercise of any of the aforementioned rights is not a prerequisite nor it prevents the exercise of another right. The obligation of information access will be fulfilled when the personal data of the holder is put to its provision, or by the expedition of copies, electronic documents or any other way determined by the responsible stated in this notice.

The response to the requests that fulfill the aforementioned requirements will be sent to the interested person via email (when provided). For security matters, we will not follow ARCO rights requests that are sent in a different way to the aforementioned.

We inform you that you have the right to start a protection of information procedure before the National Institute of Transparency, Information Access and Personal Data Protection (www.ifai.gob.mx) within the next 15 days of the reception´s date or after the conclusion of the term of 20 working days after the date of reception of the exercise of rights request made by you.
